Position Overview:
The Attorney – Fiduciary and Trustee Services will be responsible for overseeing and managing fiduciary duties on behalf of clients, including handling the trustee role for our portfolio of over 300 irrevocable life insurance trusts, as well as the responsibilities of a trustee, executor, or fiduciary advisor when the firm serves in these capacities for clients and beneficiaries. This role involves working closely with clients, beneficiaries, financial institutions, and other professional advisors to ensure the administration of trusts and estates is handled efficiently, lawfully, and with the highest ethical standards.
The Attorney – Fiduciary and Trustee Services will be responsible for overseeing and managing fiduciary duties on behalf of clients, including handling the trustee role for our portfolio of over 300 irrevocable life insurance trusts, as well as the responsibilities of a trustee, executor, or fiduciary advisor when the firm serves in these capacities for clients and beneficiaries. This role involves working closely with clients, beneficiaries, financial institutions, and other professional advisors to ensure the administration of trusts and estates is handled efficiently, lawfully, and with the highest ethical standards.
Key Responsibilities:
- Handle the fiduciary responsibilities when the firm serves as trustee of an irrevocable life insurance trust, including demand right notices, premium payments, trust accounting, policy administration and tax reporting.
- Supervise team members assisting with the ILIT portfolio.
- Handle the fiduciary responsibilities when the firm serves as a trustee, personal representative, or agent for clients.
- Manage trust and estate administration duties, including asset management, beneficiary communications, distributions, accountings, and tax reporting in coordination with the firm’s Settlement Department.
- Provide legal advice to clients acting in fiduciary roles and support clients' fiduciary decision-making.
- Identify and mitigate fiduciary risks.
- Prepare fiduciary reports, communications, and necessary legal filings.
- Interpret and apply trust instruments, wills, and other estate planning documents.
- Evaluate and review existing estate planning documents through the firm's client maintenance program to identify necessary updates based on changes in law, family circumstances, or client goals.
- Proactively recommend and implement amendments, restatements, or additional planning strategies for maintenance program participants.
- Collaborate with internal and external tax professionals, financial advisors, and other attorneys to support proper administration.
- Maintain clear, proactive communication with clients, beneficiaries, and third parties.
- Execute estate planning documents with clients.
- Support the firm’s broader estate planning, maintenance and settlement teams as needed.
Qualifications:
- Juris Doctor (JD) degree from an accredited law school.
- Active license to practice law in Nebraska, or any of the 10 jurisdictions in which we practice (NE, IA, ND, SD, MN, MO, KS, CO, KS, AZ) or ability to obtain promptly.
- Minimum of 3 years of experience in estate planning, probate, trust administration, or fiduciary services.
- Demonstrated knowledge of fiduciary responsibilities and applicable laws.
- Exceptional attention to detail, organizational skills, and ethical judgment.
- Strong interpersonal skills and client-centered approach.
- Ability to manage multiple matters simultaneously and work independently with minimal supervision.
Preferred Qualifications:
- Experience serving in a fiduciary capacity (trustee, executor, conservator, agent under POA).
- Familiarity with fiduciary accounting principles.
